California

Statute

  • California law [Public Contract Code (PCC) sections 12203(a)(b) and 12209(b) as of January 1, 2006] requires State agencies (including California State Universities) and the Legislature to spend at least 50 percent of the dollars that they spend on printing and writing papers (PW) on papers with at least 30 percent postconsumer recycled content. PW purchases must be reported in each agency's annual State Agency Buy Recycled Campaign Procurement Report.
  • State law encourages the University of California (PCC section 10507.5) and other educational agencies (Education Code section 32373) to purchase recycled paper.
  • California law [PCC sections 12217(f) and 22152(a)] directs public agencies to remove contract provisions impeding the consideration of recycled products and to replace them with performance standards.

California Rules of Court

The following 2005 California Rules of Court require the use of recycled paper for court documents:

  • Rule 201 requires court papers to be filed on paper that is at least 30 percent postconsumer content.
  • Rule 989.1 requires all courts to use 30 percent postconsumer content recycled paper for all purposes except for uses for which recycled paper is not practically available.

Federal

Under federal Executive Order 13101, federal agencies have been required to buy 30 percent postconsumer recycled content copier paper since 1999.
